Šilutė Divorce: Cheek Biting Incident & Escalating Conflict

The weekend that started with a bang turned into two episodes of violence in Šilute, after which both roommates ended up in court.

The judge stated that both the woman and the man were violent, so both must answer for what they did.

Bitten on the cheek

According to the file, the conflict between the then roommates broke out in the corridor of the apartment. Then Kristina deliberately bit her partner Andriis on the right cheek.

The conclusion of the State Forensic Medicine Service confirmed a bite wound and minor health impairment. The woman admitted her guilt and explained that she bit herself while trying to free herself, because the man did not let her go, holding her by her clothes.

Then, after calling the police, she left the apartment. It turned out that on the same day Andrius also abused a woman in the room.

He punched Kristina on the cheek. Doctors found a bruise, which was identified as a minor health disorder.

The man stated during the pre-trial that both were heavily intoxicated with alcohol, and the dispute arose over divorce and division of property. According to him, the woman started insulting him first.

Both sides admitted to consuming alcohol before the conflicts. Kristina said that the man threw her food out of the fridge, so she was getting ready to leave.

Andrius said that the woman scolded him, tried to hit him, scratched him with her nails and finally bit him. There were no other witnesses in the apartment, but the injuries were confirmed by medical documents and an examination of the scene.

The court’s assessment: both were violent

The court stated that Kristina’s cheek bite was physical violence in a close environment. The court applied the same norm of criminal law to Andrii – for punching a woman on the cheek.

According to the court, the fact that the dispute arose out of divorce and household matters does not exempt the person from responsibility, and the consumption of alcohol is considered an aggravating circumstance.

Kristina was found guilty of the bite and sentenced to 30 days in prison. Combined with the previous verdict of the Šilute Chamber of the Tauragė district court, a final sentence of 80 days of arrest was established.

True, the execution of the sentence was postponed for 9 months without intensive supervision. During this time, the woman must not use psychoactive substances and participate in a behavior correction program within 6 months.

Andrii was sentenced to a total of 60 days in prison. The court recognized him as a recidivist. The execution of the sentence was also suspended for 9 months.

The same obligations apply to the husband: not to use psychoactive substances and to participate in a behavior correction program within 6 months.

The verdict can be appealed to the Klaipėda District Court within 20 days of its publication, by submitting the appeal through the Šilutė Chamber of the Tauragė District Court.
