Young people’s favorite social network is attacked by the SACD, the organization responsible for defending the rights of authors of works (films, series, cartoons, shows, etc.) which fall within its repertoire.
TikTok is being sued by the SACD for counterfeiting. The Society of Dramatic Authors and Composers is suing the Chinese social network for summary proceedings before the Paris judicial court. For years, we have found extracts or covers of works protected by copyright in France on TikTok, explains the organization in a press release published on November 12.
However, these protected videos are broadcast “ without any authorization and (without) acceptable compensation for the authors of these works », explains the organization which manages the rights to films, series, cartoons and shows of all kinds (circus, one-man show) in France.
A lack of transparency from TikTok on its financial data singled out
TikTok is therefore attacked for counterfeiting. The SACD is responsible for ensuring that the rights of authors are respected, and of demanding withdrawal as well as payment of damages in the event of unauthorized distribution or resumption. And according to the organization, the legal action comes after a phase of dialogue which proved unsuccessful. His requests for removal of works, communicated to the Chinese social network, were unsuccessful. The four years of discussions would not have been conclusive.
In its press release, the organization also deplores “ a lack of transparency from TikTok on its financial data “. The SACD sought to know TikTok’s turnover, without success – the organization needs access to this figure to calculate copyright remuneration. The latter “ must be determined by reference to appropriate and reliable financial data “, she believes. Initiated in France, the procedure was transmitted to Ireland, the country where the company TikTok has chosen its European location.
