Midjourney’s AI Video Tool sparks Copyright Concerns with Disney and Universal Characters

A new AI-powered video tool is generating animated clips featuring characters that may be subject to copyright protection, raising concerns about intellectual property infringement.

The V1 video tool, recently released by a generative AI startup, allows users to create short animated clips from uploaded or generated images. Currently, the tool requires an image as a starting point, and text-only prompts for video generation are not supported.

The release of V1 follows a lawsuit filed by major Hollywood studios alleging copyright violations related to the AI’s image generation capabilities. The studios claim the tool infringes on their intellectual property by generating images featuring their characters.

The AI startup did not provide an immediate response to requests for comment. Representatives for the studios reiterated previous statements regarding the lawsuit, with one executive alleging the AI’s output constitutes “piracy.”

The AI developers appear to have implemented some safeguards for the video tool. Initial tests showed that prompts based on certain characters were blocked from generating animations, although images of those characters could still be created. An “AI moderator” blocked video generation when asked to animate images of specific characters, displaying a message stating, “Al Moderation is cautious with realistic videos, especially of people.”

Though, these safeguards appear to be incomplete. Testing revealed that the tool could generate animated clips of a wide range of characters. Such as, when prompted with an image of characters eating a banana, the AI generated a video showing the characters consuming the fruit.

While some prompts related to specific characters were blocked for video generation, testers were able to circumvent these restrictions by using spelling variations or repeating the prompt. The tool also allows users to provide a prompt to guide the animation, which was used to generate clips of copyrighted characters in possibly inappropriate scenarios.

The copyright lawsuit presents a critically important challenge to the AI startup, which is also facing legal action from visual artists alleging copyright infringement. The lawsuit claims that video capabilities would “only enhance ability to distribute infringing copies, reproductions, and derivatives of Copyrighted Works.”

The lawsuit includes examples of AI-generated images featuring characters. These examples were initially compiled as part of a report on the AI’s “visual plagiarism problem” by critics of AI and a visual artist.

Copyright Concerns and AI Advancement

Critics argue that despite advancements in AI graphics, fundamental solutions to copyright issues remain elusive. The use of unlicensed materials and the limitations of existing safeguards continue to be a concern.

“we still have the same situation of unlicensed materials being used, and guardrails that work a little bit but not very well.”
