JACKSONVILLE – Destiny James,27,a student transportation monitor from Jacksonville,was arrested on August 21st and is now facing charges of child neglect and theft. The Jacksonville police Department alleges that she left a child unattended in a hot vehicle while she shoplifted from a Publix grocery store on the city’s Northside.

According to the incident report, authorities arrived at the Publix parking lot to find a child inside a non-operational honda Pilot. The child was reportedly “sweating heavily and breathing with difficulty” as outside temperatures reached 91 degrees. The relationship between James and the child remains undetermined by authorities.

Jacksonville Fire and Rescue Department personnel successfully rescued the child from the SUV at approximately 10:37 a.m. The child, initially distressed, soon recovered and was medically cleared at the scene.

Surveillance footage revealed that James entered the Publix at around 10:09 a.m. Investigators stated that she spent over 30 minutes inside the store, filling a shopping cart with merchandise before bypassing all checkout lanes.

police reported that James loaded $234 worth of stolen groceries into the trunk of the vehicle before apparently realizing the child was no longer with her.

With James’s consent, officers searched her vehicle and recovered the stolen grocery items.

The arrest report indicates that James initially told emergency responders she was only inside the store briefly, but police noted that her account changed several times. Investigators also noted that she expressed remorse for her actions.

James was taken into custody and subsequently released on bond. She is currently awaiting her next court appearance.

linda Coleman, a local parent and grandparent, commented on the incident, emphasizing the dangers of leaving children unattended in vehicles. “I don’t think they should ever be left in the car for any amount of time because you never know what’s going to happen while you leave, and it’s just totally irresponsible,” Coleman stated. “I just can’t imagine how people leave a child. I wouldn’t even leave an animal in the car.”

Legal Intervention and Prevention

Under section 768.139, Florida Statutes, bystanders are legally permitted to intervene if they observe a child or pet trapped in a hot vehicle. To be granted immunity from any vehicle damage, they must:

1. Determine that the vehicle is locked or there is or else no reasonable manner for the child or animal to exit the vehicle.
2. Have a good faith belief that forcible entry into the vehicle is necessary because the child or animal is in imminent danger of suffering harm.
3. Notify law enforcement or 911 before or promptly after forcibly entering the vehicle.
4. Use no more force than necessary to enter the vehicle and remove the child or animal.
5. Remain with the child or animal in a safe location until law enforcement,fire rescue,or other emergency services personnel arrive.

Authorities are urging anyone who discovers a child locked in a hot car to immediately contact 911.
