quebec to Impose Quotas for French-Language Content on Streaming Platforms

Quebec is introducing stricter regulations for French-language content on streaming services.

Quebec Culture Minister Mathieu Lacombe introduced a bill on May 21 to increase the discoverability and accessibility of French-language content on major streaming platforms through quotas. The bill targets platforms offering music, TV, video, and audiobooks, including Netflix and Spotify.

Lacombe aims to prioritize French-language and Quebecois content, citing low consumption rates of local content, which accounts for only 8.5% of music streamed in Quebec.

The bill requires platforms to display their default interfaces in French and feature original French-language content. Non-compliant companies may face financial penalties, tho agreements for “substitute rules” can be made with the Quebec government.

The Quebec government will set content proportions or quotas for production and featuring of content on these platforms, though specific numbers have not been disclosed.

Bill 109, or “An Act to affirm the cultural sovereignty of Quebec and to enact the Act respecting the discoverability of French-language cultural content in the digital habitat,” mandates registration with the Minister of Culture and Communications and amends the Quebec Charter of Human Rights and Freedoms to include the right to access French-language cultural content.

As Quebec tightens regulations, streaming services are challenging existing content policies, arguing against content obligations imposed by the Canadian radio-television and Telecommunications Commission (CRTC).A CRTC hearing is ongoing from May 14 to 27 to redefine Canadian content (CanCon) and its regulations.

Major companies are opposing the CRTC’s implementation of the Online Streaming Act, which includes a plan to require foreign streaming companies to invest in Canadian Content funds.
