De Moraes also allowed his wife, Michelle Bolsonaro, to accompany him during the surgery at the capital’s DF Star hospital, a private center where he was treated on previous occasions for health problems.

Bolsonaro has been in prison for almost a month waiting for surgery to treat the so-called bilateral inguinal hernia, in the groin. You also need treatment to relieve hiccups.

De Moraes gave the green light on Friday to carry out an elective intervention on the former ruler, after a report from the Federal Police (PF) confirmed that he suffers from a bilateral inguinal hernia.

However, the magistrate rejected the defense’s request for Bolsonaro to serve his sentence under house arrest.

In his resolution, De Moraes authorized “elective surgical repair.”

Bilateral inguinal hernia emerges when tissues from the abdomen protrude through weak points in the muscular wall on both sides of the groin.

Since November 22, Bolsonaro has been detained, when he was preventively arrested after failing to comply with precautionary measures imposed by Justice.

At that time, the former Army captain was transferred to the capital headquarters of the PF, after the violation of the electronic anklet he was wearing was verified.

According to the file, Bolsonaro admitted having tried to manipulate the device with a soldering iron. Three days later, De Moraes ordered him to begin serving his sentence, more than 27 years in prison, in a closed regime, for attempted coup.

When analyzing the request for home confinement, the magistrate stated that there is a “total absence of the legal requirements” to grant the benefit.

In his decision, he mentioned repeated violations of precautionary measures and the existence of specific acts that, in his opinion, show a risk of flight.

“The detained Jair Messias Bolsonaro does not have the right to house arrest,” said Moraes, recalling that he was convicted of crimes considered very serious against the Democratic Rule of Law, committed with violence and serious threats.
