A recent ruling by the International Trade Court has considerably curtailed the ability of president Donald Trump to impose broad tariffs under the International Emergency Economic Powers Act (IEEPA) of 1977. Spokesman Kush Desai stated that the “commercial deficit is a national emergency” that “has decimated the American communities, left behind our workers and weakened our industrial defense base, facts that the court did not play.”

Desai also questioned the legitimacy of the judges behind the ruling. “It does not correspond to not chosen judges to decide how to adequately address a national emergency,” he saeid in a statement. “President Trump promised to put the United States first, and the administration is committed to using each lever of the Executive Power to address this crisis and restore US greatness,” he added.

President Trump has utilized tariffs as a negotiation tool, aiming to compel other nations to negotiate agreements more favorable to the United States, suggesting he would impose tariffs if terms were unsatisfactory.He also asserted that tariffs would incentivize manufacturers to bring industrial jobs back to the United States and generate enough revenue to reduce federal budget deficits.

The Government has already appealed the ruling, seeking to reinstate the import tariffs. The judicial document states, “It is notified that the defendants resort to the United States Court of Appeals for the Federal Circuit, the opinion and Definitive Court Judgment of the May 28, 2025.”
