Argentina updates Immigration Policies on Healthcare, Education

The Argentine government has enacted significant changes to its immigration policies, impacting residency, healthcare, and education access for foreigners. Decree 366/2025, published in the Official Gazette, outlines the updated regulations.

The new rules establish “new entrance and residence criteria to regulate the permanence of foreigners.” The decree states, “The state in all its jurisdictions will ensure the equal access of immigrants to the same conditions of protection, amparo and rights enjoyed by nationals, in accordance with the rights and obligations corresponding to each immigration category, in particular in relation to social services, public goods, health, education, justice, work, employment and social security.”

The updated regulations include modifications to healthcare access for permanent resident foreigners, who “will be able to access the public system on equal terms that Argentine citizens.” Though, the decree clarifies that in state-administered healthcare facilities, “only medical treatment or habitual health care will be provided “against the presentation of insurance or the previous cancellation of the service in accordance with the conditions established by the Ministry.”
