Several major companies, including L’Oréal (France), Dyson (UK) and Bausch + Lomb, have formally filed lawsuits against the US government seeking reimbursement for tariffs imposed under Donald Trump’s presidency. This legal action comes shortly after a historic ruling by the United States Supreme Court declaring these customs duties illegal.
The complaints, filed February 23 in the United States Court of International Trade, add to the growing list of major companies taking legal action following the Supreme Court’s landmark February 20 ruling. The latter concluded that Donald Trump had exceeded his powers by imposing customs duties under the International Emergency Economic Powers Act (IEEPA). This week, FedEx and the American cosmetics and perfume company Sol de Janeiro also filed a lawsuit.
According to court documents, more than 1,400 importers, including Costco and Goodyear, have filed lawsuits seeking refunds of their taxes. Commercial lawyers predict a new wave of litigation as companies seek to recover billions of dollars in taxes. However, the reimbursement process remains subject to lower court guidelines and could take months or even years.
