San José Municipality Shuts Down Soda Tapia Location

A popular Soda Tapia location, situated on teh east side of La Sabana Metropolitan Park, has been shuttered by the Municipality of San José. The closure stems from the establishment’s failure to renew its health permit, which expired on March 10th. This action underscores the municipality’s commitment to enforcing regulatory compliance and safeguarding public health.

Timeline of Events Leading to Closure

The sequence of events leading to the closure began with a formal complaint lodged against Soda Tapia establishments in the Hospital and Mata Redonda districts. Following this complaint, the Municipality’s Patent Section conducted an inspection of the premises on March 21st. The inspection revealed that the location near the national gym was operating with an expired health permit.

The Municipality granted Soda Tapia a grace period of ten business days to rectify the situation. However, a subsequent inspection on April 8th revealed that the establishment had not complied with the directive and continued to operate without a valid permit. Consequently, municipal authorities ordered the immediate closure of the premises.

Unpaid Taxes Compound Soda Tapia’s Troubles

Beyond the permit issue, Soda Tapia also faces significant financial challenges. The local government has reported that the business owes ¢10,158,967.67 in unpaid patent taxes. This debt has been accumulating as the fourth quarter of 2021. To date, only a partial payment of ¢1,017,612.56 has been made as part of a payment arrangement.

According to recent data from the Ministry of Finance, tax evasion remains a persistent problem for businesses in Costa Rica, with an estimated 15% of companies failing to fully comply with their tax obligations. This situation not only impacts government revenue but also creates an uneven playing field for businesses that adhere to the law.

Past Encounters with Regulatory Issues

This is not the first time Soda Tapia has encountered regulatory difficulties. In 2021, the General Directorate of Taxation temporarily closed four Soda Tapia locations due to tax payment breaches. The affected restaurants were located in La Sabana, Rohrmoser, Santa Ana, and Alajuela.

This history of non-compliance raises questions about the company’s commitment to adhering to legal and regulatory requirements. The Municipality of San José has emphasized its dedication to ensuring that all businesses within the canton operate within the bounds of the law.

The Municipality of San José reiterates its commitment to the legality and regulatory compliance with economic activities within the canton, in the protection of public health and the municipal order.
