Police Assignments: New PP Regulation – 2026 Update

The Coordinating Minister for Law, Human Rights, Immigration and Corrections, Yusril Ihza Mahendra, said that the government chose to issue a Government Regulation (PP) instead of immediately revising Law Number 2 of 2002 concerning the National Police of the Republic of Indonesia (UU Polri) in regulating the assignment of Polri members outside the police structure. Yusril said that the steps in drafting the PP were taken to resolve legal issues following the Constitutional Court (MK) decision.

“The government is currently focused on resolving the problems following the Constitutional Court’s decision and the polemic over Perpol Number 10 of 2025 so that it does not spread elsewhere. Drafting the PP will clearly be faster than drafting the Law. Therefore, the President chose to regulate it through the PP,” said Yusril to journalists, Sunday (21/12/2025).

Yusril explained that Article 19 of Law Number 20 of 2023 concerning State Civil Apparatus (UU ASN) strictly stipulates that certain ASN positions can be filled by TNI soldiers and members of the National Police, with further provisions having to be regulated in Government Regulations. In this way, the drafting of the PP becomes a clear and constitutional legal basis.

Meanwhile, Article 28 paragraph (4) of the National Police Law confirms that members of the National Police can occupy civil bureaucratic positions outside the police if they retire or resign. According to him, the latest PP will regulate any positions that are related to the police so that they can be filled by National Police personnel.

“The PP that has been drafted is intended to implement Article 28 paragraph (4) of the National Police Law, the decision of the Constitutional Court, as well as Article 19 of the ASN Law. This PP will later replace and at the same time reorganize what positions can be filled by members of the Police which were previously regulated in Perpol Number 10 of 2025,” he explained.




Yusril then touched on the position regulations for TNI personnel which have been regulated at the legal level in Law Number 34 of 2004 concerning the Indonesian National Army (UU TNI). He emphasized that the choice of legal instrument is the policy of the legislator.

“The TNI Law chooses to regulate it directly in law. With PP there are no problems either. Even though Article 28 paragraph (4) of the National Police Law does not explicitly order further regulation through PP, based on Article 5 of the 1945 Constitution, the President has the authority to determine PP to implement the law as it should,” said Yusril.

He added that the decision whether the National Police Law will be revised or not depends entirely on the results of the work of the National Police Reform Acceleration Commission chaired by Jimly Asshiddiqie, as well as the President’s policy direction after receiving recommendations from the commission.

“Whether in the future the National Police Law will be changed or not depends on the results of the work of the Commission for the Acceleration of Police Reform and the President’s policy after the commission completes its work,” he said.

Yusril revealed that the process of formulating the PP had begun two days ago involving the Ministry of PANRB, the Ministry of State Secretariat, and the Ministry of Law, under the coordination of the Coordinating Ministry for Kumham and Imipas. The President, said Yusril, has approved the arrangement for the assignment of National Police members to civilian positions to be carried out through the PP.

“It is hoped that by the end of January 2026, the PP will be completed,” concluded Yusril.
