A federal judge has rejected a request for a mistrial in the sex trafficking trial of sean “Diddy” Combs. The decision came after defense attorneys argued that prosecutors improperly suggested to the jury that the music mogul interfered with the investigation into rapper Kid Cudi’s firebombed Porsche in 2012.

Mistrial requests are not uncommon in lengthy federal trials, especially those involving extensive evidence and numerous witnesses. However, this was the first such request in Combs’ trial, which is currently in its third week in Manhattan. Combs has been actively participating in his defence, frequently consulting with his legal team.

Judge Arun Subramanian instructed the jury to disregard testimony regarding the destruction of fingerprint cards related to the firebombing. The incident occurred after Combs allegedly became angry that Cudi was dating Cassie, the singer who had a nearly 11-year relationship with Combs from 2007 to 2018.

according to Lance Jimenez, an arson investigator for the los angeles Fire Department, the Molotov cocktail used to set fire to Cudi’s car in Hollywood Hills was made from a 40-ounce old English 800 malt liquor bottle and a designer handkerchief. Photos of the scene were presented in court.

The defence’s mistrial request was prompted by Jimenez’s testimony that fingerprints taken from Cudi’s burned-up Porsche 911 were destroyed in August 2012, approximately eight months after the fire. Jimenez stated that an individual within the Los Angeles Police Department,not involved in the investigation,ordered the destruction of the fingerprint cards,which he noted was not standard procedure.

Combs, 55, has pleaded not guilty to charges of leading a 20-year racketeering conspiracy involving fear and violence. If convicted, he could face a prison sentence ranging from 15 years to life. Cassie and other witnesses have testified that Combs repeatedly beat her and coerced her into unwanted sexual acts.

Defence attorney Alexandra Shapiro requested the mistrial during a break, arguing that “prosecutorial misconduct” had occurred and that “ther’s no way to un-ring this bell.”

Shapiro stated that during jury selection, some prospective jurors were dismissed because they believed Combs could perhaps evade the racketeering charges due to his wealth.

“These questions were designed to play right into that,” she said.

Defence lawyer Marc Agnifilo described the prosecution’s conduct as “outrageous.”

Combs’ lawyers contended that the prosecution’s questions and Jimenez’s testimony were prejudicial, implying Combs was involved in the destruction of evidence.

“A mistrial is absolutely unwarranted here.”

Assistant US Attorney Christy slavik countered that “a mistrial is absolutely unwarranted here”. She explained that the fingerprint issue was raised to refute defence claims that the car firebombing investigation was inadequate and that the area was not properly searched for fingerprints.
