Broadcasting Contribution Lawsuit: Leipzig Court Review

A plaintiff from Bavaria defends herself against the payment of the broadcasting contribution because, in her view, the program is neither diverse nor balanced.

In addition, public service broadcasting serves as a vicarious agent of the prevailing state opinion power. This structural failure is also based on a lack of state -distant state of supervisory bodies, the woman justifies her lawsuit. This lacks an individual advantage that justifies the obligation to contribute.

The courts had rejected the lawsuit in the two lower courts.

Contrary to the plaintiff’s view, the justifying advantage was solely in the individual option of being able to use the public service broadcasting, the Bavarian Administrative Court said. The question of whether there is a “general structural failure” in the absence of a variety of programs and the program of programs does not matter.

The obligation to broadcast the broadcasting contribution could not be countered that, according to its overall structure, the program offer was not geared towards balance and diversity.
