Milan, 19 February (Adnkronos) – “There was no undue processing of personal data: on the computer of the Bellavia Ferradini firm, the contents of which were illicitly copied by the former collaborator Varisco, there are technical consultancy reports carried out by the professional on complex cases and based on attachments which – as the subject of the accountant’s work – were kept in the historical archive of the firm”. This was reiterated in a note by the lawyer Luca Ricci, defender of Gian Gaetano Bellavia, investigated by the Milan Prosecutor’s Office for violation of the privacy law, and yesterday questioned by prosecutors Eugenio Fusco and Paola Biondolillo to whom he “exhaustively reconstructed the facts” and clarified “the correctness” of his actions.
In the computer of the accountant Bellavia, consultant of various prosecutors’ offices and of the program Report, as in the one used by Valentina Varisco – accused of having stolen a million files from him – “there were absolutely no documents not returned following the outcome of the judicial assignments” and the documents subject to appropriation “are those in digital format used as well as attached to the technical consultancy reports and kept – as works of the firm – in the historical archive of the professional activity”.
Furthermore, “In this case, data processing for purposes unrelated to those related to the professional or consultancy role is completely outside the scope of this case. There has been no disclosure” we read in the defense note. The conservation was organized “to avoid access not only from outside but also from inside” the professional office, “unfortunately, however, the illicit and unfaithful conduct described in the charges was carried out by the employee who had the mandate to take care of the IT systems”.
