German Court Upholds Deportation Order for ISIS Leader Abu Walaa

A German court has rejected the final appeal of Abu Walaa,a former leader within the Islamic State (ISIS),paving the way for his deportation to Iraq after serving his prison sentence.

Abu Walaa, a 41-year-old Iraqi national, is currently incarcerated in Germany and scheduled for release in May 2027. upon his release, German authorities intend to deport him to Iraq. The Düsseldorf Administrative Court has now affirmed the deportation order, dismissing Walaa’s appeal.

The court stated that there was no credible evidence suggesting that Walaa had disavowed his past involvement with ISIS or undergone deradicalization. The judge emphasized a continued risk of reoffending, citing the significant danger he poses to public safety. The court also determined that thes concerns outweighed the interests of his seven children residing in Germany.

Walaa’s lawyer’s request to suspend the proceedings pending an expert assessment of his potential danger was denied.

In 2021,a court in Celle convicted the Islamic preacher of supporting and being a member of a foreign terrorist institution,following a trial that spanned over three years. The court determined that until his arrest in 2016, he propagated a jihadist ideology as an imam in a mosque located in Hildesheim.

According to the presiding judge, “he had been appointed by Islamic State as its de facto top representative in Germany.”

though, the deportation of Abu Walaa may face obstacles.The Iraqi government has not provided assurances that Walaa will not face execution upon his return, potentially hindering the German government’s ability to proceed with the deportation.
