Choi Jung-hyun,the newly appointed president of the Incheon District Lawyers Association,representing over 800 lawyers across Incheon,Bucheon,and Gimpo,has outlined a vision for this transformative period. with two decades of legal experience in the region, Choi aims to strengthen interaction between the legal community, the courts, and the prosecution, ensuring that the public receives the legal support they require.

The Incheon Lawyers’ Society is a group with more than 800 lawyers.

Strengthening Legal Infrastructure: The Incheon High Court

The approval of the Incheon High Court bill in November 2024 marked a pivotal moment for the region. This long-awaited progress promises to bring justice closer to the people of Incheon, reducing the need to travel to Seoul for certain legal proceedings. The establishment of Criminal and administrative Tribunals within the Seoul High Court Incheon branch in february was a preliminary step, addressing a previous gap where, despite holding trials outside of Seoul since 2019, criminal and administrative cases could not be fully processed locally.

Currently, the South Korean court system operates on a three-tiered structure: District Courts, High Courts, and the Supreme Court. The addition of a High Court in Incheon will streamline the appeals process for residents and businesses in the region.

Addressing Future Challenges and Opportunities

While the establishment of the Incheon High court is a significant achievement, challenges remain. The prompt opening of the Incheon District Court is crucial to ensure adequate space and resources for the High Court to function effectively by its target opening in 2028. The planned Northern Branch Court, spanning approximately 46,000 square meters in Dangha-dong, Seo-gu, is also a vital component of this expansion.

Northern support should be completed and opened as soon as possible. We will continue to speak with Incheon citizens.

Attracting the Maritime Court: A Boost for International Trade

Recognizing Incheon’s strategic importance as a major port city, the Incheon Lawyers society is actively campaigning to attract the Maritime Court. This specialized court would handle disputes related to marine, shipping, and logistics, addressing the numerous conflicts arising from interactions with foreign vessels and shipping companies. Currently, the absence of a dedicated maritime court forces parties to rely on foreign trials and arbitration, leading to significant financial losses.

The stakes are high, with estimates suggesting that between ₩200 billion and ₩500 billion (approximately $150 million to $375 million USD) in marine-related contract and dispute costs are lost annually to foreign jurisdictions. Establishing a Maritime Court in Incheon would not only retain these funds but also position the city as a leading center for maritime law.

while Busan is also vying for the Maritime court, the Incheon Lawyers Society is collaborating with local government and civic groups to highlight Incheon’s suitability. Efforts include a signature campaign and parliamentary debates to demonstrate the widespread support for this initiative.
