Mandatory Registration Fee for Live-In Couples in Uttarakhand: Rs 500 to Begin With

Uttarakhand has made history by becoming the first state in India to enforce the Uniform Civil Code (UCC). This new law aims to bring uniformity in personal civil matters, regardless of caste, religion, gender, and other sundry factors.

New Rules for Live-In Couples

With the enforcement of these rules, live-in partners are now required to register themselves with the district registrar both when they enter into and terminate a relationship, failing which they could face a jail term of up to six months.

Section 378 of the UCC Bill

Section 378 of the UCC bill makes it mandatory for any man and woman residing in the state, whether they are residents of Uttarakhand or not, to submit a “statement of the live-in relationship” to the concerned registrar.

Registration Process

The Rules, which came into effect on January 27, outline the documentation required for registration. This can be done both offline and online. Rule 15 (3) in Chapter 5 specifies the “information to be included in the Statement of Live-in Relationship,” which must be attached with a 16-page form—Form 3 of the Annexures to the Rules—by those already in or intending to enter into a live-in relationship.

Termination of Relationships

If a couple decides to end their relationship, they are required to provide notice to each other and the Registrar to ensure the termination is recognized by the authorities.

Registration for live-in couples costs Rs 500. A delay in registration by more than a month attracts an additional fee of Rs 1,000. Similarly, termination of such relationships also requires registration at a cost of Rs 500.

Additional Regulations

Residents of Uttarakhand living outside the state must submit the status of their live-relationship to the registrar within their jurisdiction. According to the legislation, delays or providing false information could result in a jail term of up to six months and a fine of Rs 25,000.

Children in Live-In Relationships

The legislation confirms that children born out of a live-in relationship are “legitimate,” thus granting them the same rights and benefits as those from legally wedded parents.

Maintenance Rights

The bill also mandates the payment of maintenance, similar to what is provided in marriage, if the woman is deserted by her partner in a live-in relationship.
