Shortly before the summer vacation, however, it was decided not to enter into the employment relationship.
Community fears years of legal dispute
According to the municipal council Roger Wüthrich, responsible for the education department, an external legal counsel was consulted. There have been fear that an appeal could lead to a long -term legal dispute to the Federal Supreme Court. The school has always stood behind the teacher, but as a small community could not carry such a procedure.
The decision was made in mutual agreement – also to protect the teacher, since the discussion in the village had led to polarization.
Criticism of the decision
The teacher concerned did not publicly comment. There is criticism of the decision in the village. For example, the local SP President Iris Wäckerlin said that the school is sending a sign of intolerance. Many parents and teachers would have stood behind the young teacher. It is open whether a substitute teacher would be found by the start of school.
Legal professor Thomas Geiser legally classifies the case for the Tamedia newspapers. The state is bound to religious freedom, which includes wearing a headscarf. A school can generally prohibit religious symbols – but that also applies to cross chains. A selective regulation, on the other hand, is discriminatory.
