Surabaya’s DPRD Commission D recently convened a hearing to address serious allegations leveled against UD Sentoso Seal, a local business. The accusations range from the unlawful confiscation of employee diplomas to disturbing reports of wage deductions for employees observing Friday prayers and restrictive workplace conditions.

Dr. Akmarawita Kadir, Chairman of the Surabaya DPRD Commission D, expressed deep concern over the alleged mistreatment of employees at UD Sentoso Seal. The accusations include not only the withholding of diplomas but also practices that infringe upon basic human rights and religious freedoms.

Company Owner Denies Wrongdoing Amidst Mounting evidence

The hearing brought together key stakeholders, including Jan Hwa Diana, the owner of UD Sentoso Seal, affected former employees, and representatives from the Surabaya Department of Industry and Manpower (Disperinaker) and the East Java Department of Manpower and Transmigration (Disnakertrans). Despite the presentation of evidence by former employees, Diana has reportedly denied the allegations of diploma confiscation.

Dr. Akmarawita Kadir emphasized the need for a thorough investigation, stating, He said 31 people whose diplomas were held, this should be sought.

Legal Ramifications and Potential Criminal Charges

Commission D has urged Disperinaker Surabaya and East Java Disnakertrans to investigate the diploma confiscation case thoroughly, citing potential violations of Article 42 of East Java Regional regulation Number 8 of 2016. This regulation addresses labor rights and protections within the region.

Achmad Zaini, Head of the Surabaya Manpower Office, clarified the severity of the situation, stating that the confiscation of diplomas falls under the criminal category based on Pergub No. 8 of 2016 and could lead to charges under the Criminal Code. This provides a legal basis for law enforcement to intervene and address the alleged crimes.

Company’s lack of Cooperation Hinders Investigation

Tri Widodo, Head of the East Java Disnakertrans Supervision and K3 Division, expressed frustration with the company’s lack of cooperation during the inspection process. He stated that the company owner has been evasive, claiming to forget the identities of former employees and the details surrounding the allegedly confiscated diplomas.

The company does not explicitly argue or acknowledge. Their answers are only ‘forgetting’. Now this is what makes it difficult to settle.
