A wave of public disapproval has followed the Jayapura District Court’s decision to acquit Brigadier two Alfian Fauzan Hartanto in a child abuse case that occurred in Kaerom Regency, Papua, in 2022. The controversial verdict, delivered on January 23, 2025, has prompted scrutiny from the Judicial Commission and drawn attention to the complexities of the Indonesian legal system.
Supreme court Awaits Official Report
According to a Supreme Court spokesperson, the court is currently unaware of the specifics surrounding the Jayapura District court’s ruling. The spokesperson, identified as Yanto, stated that the Supreme Court will not proactively investigate the panel of judges unless a formal complaint is filed. We do not know what the decision is like, if it is really free, the Criminal Procedure Code also regulates the free decision,
Yanto said, emphasizing the importance of due process. He further added that If there is a report directly followed up.
Judicial Commission Investigates Potential Misconduct
The Judicial Commission (KY) has launched an investigation into the controversial acquittal. Methodius Kossay, coordinator of the Papua Judicial Commission, confirmed that the victim’s legal counsel filed a report on March 18, 2025, alleging misconduct by the Jayapura District Court judge. Mukti Fajar, a spokesperson for the Judicial Commission, stated that the commission will analyze the court’s reasoning, particularly the reliance on witness wishes as a basis for the acquittal. The KY will also review the evidence presented by the Public Prosecutor during the trial.
In the case of sexual harassment, the judge needs to explore the facts as other evidence.

Furthermore, the Judicial Commission is open to examining other parties who may possess information regarding potential violations of the Judge’s Code of Ethics and Behavioral Guidelines (KEPPH). The commission will verify the report to ensure it meets the necessary administrative and substantive requirements before formally registering it.
Details of the Acquittal
The Jayapura District Court panel of judges, led by Zaka Talpatty and including Waroi Korneles and Ronald Lagerboom, acquitted Bripda Alfian of all charges. The verdict, case number 329/Pid.Sus/2024/PN Japan, stated that Alfian was not proven legally and convincingly guilty
of the alleged crimes. Consequently, the court ordered his immediate release from detention.
This decision starkly contrasts with the Public Prosecutor’s demand for a 12-year prison sentence, along with a fine of Rp 200 million and a six-month confinement.
Implications and Future Steps
The acquittal has raised concerns about the handling of child abuse cases within the Indonesian judicial system. The Judicial Commission’s investigation will be crucial in determining whether the judges acted appropriately and ethically. This case highlights the ongoing need for judicial reform and increased accountability to ensure justice for victims of child abuse. The Supreme Court’s response to the Judicial Commission’s findings will also be closely watched, as it could set a precedent for future cases involving similar allegations of judicial misconduct.
