The court’s decisions mandate that the time nurses spend dressing and undressing for work be officially recognized as working time. This ruling compels the ASL To4, the local health authority, to compensate the nurses for back pay, accrued interest, and legal expenses.

The Court of Cassation, Italy’s highest court of appeal, has previously issued ordinances (including n. 3901/2019 and n. 9306/2022) affirming that dressing and undressing time shoudl be considered part of working hours when these activities are mandated for safety, hygiene, or organizational reasons.This legal foundation strengthens the argument for compensating healthcare workers for this time.
Contradictions with Current Healthcare Agreements
Despite the legal precedents, the issue remains contentious within the healthcare sector. the current National collective Labor Agreement (CCNL) for healthcare only formally recognizes dressing time if it is subject to clocking-in procedures and limited to a total of 10 minutes per shift.This provision is increasingly viewed as inadequate considering the recent court rulings,which underscore the importance of recognizing all work-related activities.
