Elon Musk’s Massive Offer Rejected by OpenAI: The Battle Over Artificial Intelligence
The tech world is abuzz with a dramatic rejection of a near-$100 billion offer for OpenAI by Elon Musk, founder of renowned companies like Tesla and SpaceX. This contentious bid highlights a power struggle over the future of the world’s leading AI research organization, OpenAI, creator of the well-known AI tool, ChatGPT.
The Unsuccessful Offer and Its Subtle Agendas
Despite the magnificent sum, OpenAI’s board of directors has rebuffed Musk’s unsolicited bid. Yet, some industry experts suggest that the rejected offer might still serve a purpose in Musk’s strategy. Johnnie Penn, an associate teaching professor at the University of Cambridge, noted in a BBC interview that “Musk is basically trying to stymie OpenAI’s growth trajectory.”
Musk’s Proposal in Context
Last week, Musk and his consortium of investors, including Hollywood superagent Ari Emanuel, presented a valuation of $97.4 billion (£78.4 billion) for all of OpenAI’s assets. Although substantial, it falls short of the estimated $157 billion valuation given in a funding round just four months earlier, and experts estimate its actual value to be closer to $300 billion.
Complicating the scenario is OpenAI’s unique structure, consisting of both non-profit and for-profit arms. Altman reportedly aims to dismantle the non-profit board, potentially causing conflicts. Musk’s proposal seems to be inflating the value of the non-profit assets, making the transition costlier for Altman.
“What Musk is trying to do here is raise the perceived value of the non-profit arm of OpenAI, so that OpenAI has to pay more to get out of the obligations it has to its own non-profit,” explained Dr. Penn.
Musk’s Motivations and Criticism
Musk justified his bid by stating his desire to return OpenAI to its roots and focus on its original mission of developing AI for humanity’s benefit. However, others speculate that his motives may have less altruistic underpinnings, tied to his own AI ventures xAI and Grok, which have received mediocre public responses.
Lutz Finger, a senior lecturer at Cornell University and founder of AI startup R2Decide, argued that “Musk has missed the AI train, somewhat. He’s behind, and he has made several attempts to catch up. Now, Musk is trying to kneecap his most formidable competitor.”
Tension Escalates
The already tense relationship between the two business leaders has taken a more acrimonious turn. Altman publicly taunted Musk’s offer on X (formerly Twitter), while Musk responded with harsh words, calling Altman a “swindler.” In an interview with Bloomberg, Altman reciprocated by questioning Musk’s mental state, asserting that his decisions arise from “a position of insecurity.”
The dispute also spilled into the courtroom, as U.S. district judge Yvonne Gonzalez Rogers considers Musk’s request for an injunction that would halt OpenAI’s planned conversion. Musk claims that he would suffer irreparable harm without judicial intervention.
“It is plausible that what Musk is saying is true. We’ll find out. He’ll sit on the stand,” Gonzalez Rogers commented during a hearing in Musk v Altman in Oakland, California.
The Legal and Ethical Implications
OpenAI’s legal team argues that Musk’s recent bid is inconsistent with his earlier claims that OpenAI’s assets cannot be transferred for private gain. Their reply brief states that Musk’s constraints do not apply outside the courtroom as long as he or his associates are the buyers.
“I think he’s just trying to create noise and news and consternation,” Karl Freund, founder and principal analyst at Cambrian-AI, asserts. However, Freund also notes that Musk’s strategy could significantly damage his own reputation.
“He’s brilliant. He creates incredible companies that are doing incredible things. But his personal agenda is causing people to question his motives,” Freund observes, highlighting the ethical considerations surrounding the dispute.

The tension between Musk and Altman is likely to persist, with both parties leveraging every platform to portray their stance. As the legal proceedings and public debates continue, the fate of OpenAI hangs in the balance.
