Knesset approves Controversial Judicial Overhaul

After more than two years of intense political debate, the Netanyahu government’s legal reforms have been enacted by the Knesset. This legislation aims to grant the Israeli government greater influence over judicial appointments and curtail the authority of the Supreme Court. While proponents hail it as a landmark achievement, critics denounce it as a “legal coup,” raising profound questions about the future of Israeli democracy.

The reforms have ignited fierce opposition, with detractors already challenging the amendment’s legality. A key provision, which increases political sway over judicial selections, is slated to take effect following the October elections next year. Multiple appeals have been promptly lodged with the Supreme Court, setting the stage for a protracted legal battle.

Checks and Balances Under Scrutiny

According to Peter Malcontent, a historian at utrecht University and an expert on Israeli affairs, the absence of a formal constitution and a Senate in Israel underscores the critical role of judicial oversight. Legal counter gas by higher and lower judges is the way in Israel to control a runaway government. That is why it is so important how judges are appointed. He argues that judicial review serves as a crucial mechanism to restrain governmental overreach, making the appointment process particularly sensitive.

The newly passed law alters the composition of the judicial appointment committee. While the government cannot unilaterally appoint judges, the legislation shifts the balance of power within the committee. Previously, two of the nine members were selected by the Israeli bar Association; now, they will be chosen by the government coalition and the opposition. These members will also possess veto power over judicial appointments, raising concerns about potential political interference.

The judiciary is being politicized. Lawyers who have ambitions to become high judge will take into account the political views in the Knesset in all their decisions. Because they know that if they are later a candidate for an appointment, politics will also have a voice in it.

Public Outcry and political turmoil

Justice Minister Levin celebrated the Knesset vote as “written history,” while another Knesset member from the right wing asserted that the law “returns the power to decide to the citizen.” Though, these reforms have been met with widespread public resistance. Since the initial proclamation of the plans in early 2023, large-scale social opposition has emerged. For months, hundreds of thousands of protesters have flooded the streets of Tel Aviv and other cities, voicing their discontent. In March, trade unions even staged a general strike, temporarily shutting down essential services, including hospitals.

The Hamas terrorist attacks on October 7, 2023, temporarily overshadowed the legal reform debate, as the nation grappled with the Gaza War and the plight of hostages held by Hamas. Though, in November of the following year, the cabinet declared its intention to proceed with the bill. The progressive newspaper Haaretz cautioned that the law “will be felt mainly by the Supreme Court and the citizen,” particularly considering several sensitive cases currently before the court.
