The Admission: Acknowledging Missteps
North Rhine-Westphalia’s Justice Minister, Benjamin Limbach, has admitted to shortcomings in a recent judicial appointment procedure. Appearing before a state parliamentary investigation committee in Düsseldorf,Limbach conceded that the process “did not go well,” describing his approach as “somewhat technocratic and unsuspecting.” This admission comes amidst mounting pressure and allegations of impropriety.

Allegations of Nepotism and Manipulation
The core of the controversy revolves around the appointment to the executive chair of the Higher Administrative Court (OVG) in Münster. Limbach is accused of attempting to install a familiar acquaintance without adhering to standard selection protocols. Opposition parties, including the SPD, FDP, and AfD, have leveled accusations of nepotism
and inappropriate proximity
to the candidate.
The situation escalated when two candidates filed complaints against their exclusion, leading the Münster Administrative Court to halt the procedure in September 2023. The court deemed the process illegal
and manipulative.
This legal intervention underscored the severity of the alleged irregularities.
Conflicting Testimonies and Serious Accusations
Further complicating matters, a judge from the Federal Administrative Court, who was a subsequent applicant, submitted an affidavit implicating Limbach and the head of the State Chancellery, Nathanael Liminski (CDU). The judge alleged that both individuals pressured them to withdraw their submission, suggesting a preference for a candidate affiliated with the CDU party.The judge described this as “patron saint” and “favorite economy” tactics, stating, I was and cannot be accepted.
The judge further asserted that such governmental behavior damages the reputation of politics, holding Minister Limbach responsible.
Limbach has countered these accusations with his own affidavit, creating a situation of conflicting testimonies. He maintains that the selection process was based on merit and denies any attempts to influence candidates to withdraw.
I was and am not biased. The selection process was carried out with strict attention to the best selection.

Contradictions and the search for Truth
Following Limbach’s five-hour testimony, SPD parliamentary chairman nadja Lüders expressed skepticism, stating that the minister failed to resolve contradictions and inconsistencies. Lüders suggested that the investigation committee might be reaching its limits in uncovering the truth through witness questioning alone.
After all, at least one in this story cannot say the truth.

Moving Forward: Reforming the Appointment Process
The position at the head of the OVG has remained vacant for nearly four years,a situation limbach acknowledges as unsatisfactory. He has announced plans to re-evaluate and improve the appointment process, presenting cornerstones for reform aimed at strengthening public trust in judicial appointments. This includes a commitment to question, analyze and improve processes
.
The next committee meeting will involve interviews with Nathanael Liminski and Ansgar Heveling (CDU), both of whom are alleged to have communicated with one of the applicants. Prime Minister Hendrik Wüst (CDU) and Deputy Prime Minister Mona Neubaur (Greens) have also been invited to provide testimony.
