The Masimo Medical Monitoring Technology Company MASI He sued the US Customs and Border Protection *on Wednesday for a decision by the agency that allowed Apple AAPL to import Apple Watch with oxygen reading technology in the blood during a dispute on patents between companies.
Masimo said in the case (link) at the Federal Court of Washington DC that the customs authorities have improperly established that Apple can import watches with pulseximetry technology, reversing their decision last year without informing Masimo.
Masimo told the court that he had become aware of the decision of the agency of 1 August only after Apple announced that he would reintroduce the reading of oxygen in his blood in his watches last week.
The spokesperson for Apple and customs did not immediately respond to requests for comment. A spokesman for the Masimo refused to comment.
Masimo, based in Irvine, California, accused Apple of having hired his employees and having stolen his pulseximetry technology to use it in the Apple Watch. Masimo cited Apple separately for violation of patents and theft of commercial secrets in current federal causes.
Masimo convinced the United States International Commerce Commission to block the imports of the Series 9 and Ultra 2 smartwatchs in 2023, establishing that Apple’s technology for reading oxygen levels in the blood violated mash patents.
After the ITC decision, Apple continued to sell watches redesigned and approved by the customs without pulseximetry.
On August 14, Apple said he would reintroduce the reading features of the oxygen in the blood of his smartwatches with the approval of the customs. Masimo said that the agency’s decision to approve watches without the contribution of Masimo or a “significant justification” has deprived the company of his rights.
“The function of the CBP is to enforce the Eitc exclusion orders, not to create escapades that make them ineffective,” said Masimo.
Masimo asked the Washington court to block the agency’s decision and to continue preventing Apple from selling watches with the blood oxygenation function.
