The trial will begin on May 26th. According to the accusation, the lawyer took possession of 57,500 euros, only partially compensating his clients
The next one will start 26 maggiobefore the single judge of Lamezia Terme, the trial against the lawyer Nicolino Sesto, recipient of an immediate judgment decree for embezzlement.
According to the prosecution, the lawyer, in May 2024, would have unlawfully retained for himself the sum of 57,500 euros with nothing left to pay into the account of their clients, a mother and two daughters, widow and orphan of a man who died in a road accident.
According to the reconstructions carried out by the Financial Police Group of Lamezia Terme, led by commander Giuseppe Maniglio, and coordinated by prosecutor Emanuela Costa, the lawyer, in his capacity as attorney general of his clients, had sponsored the out-of-court settlement with the insurance company following the accident in which the clients’ husband and father lost his life.
According to the prosecution, the lawyer had requested and obtained from the insurance company the crediting of three separate transfers with a total value of 240 thousand euros, of which 40 thousand went to the widow and 100 thousand euros each to the orphans. The lawyer was entitled to the sum of 23 thousand euros for the work carried out.
According to the accusation contested by the Prosecutor’s Office of Lamezia Terme, Sesto failed to comply with the provisions of the Court regarding the obligation to bind the sum due to each girl (minors at the time) in non-risky investments registered in the names of the young women. The lawyer would have paid 35 thousand euros into the widow’s account135 thousand euros in the account of one daughter and 12,500 euros in favor of the other daughter, keeping for himself the sum of 57,500 euros and responding to the widow’s requests that nothing more was owed to her.
The woman, however, filed a complaint and the trial to establish the rights and wrongs in this matter will begin on May 26th.
