Lampung Police: Anak Tuha Residents & PT BSA Land Dispute

Lampung city – Lampung Regional Police Chief Inspector General Helfi Assegaf appealed to the people of three villages in Anak Tuha District, Central Lampung Regency who still occupy and control land with Cultivation Rights (HGU) belonging to PT Bumi Sentosa Abadi (BSA) to be cooperative and respect the applicable legal process.

Helfi emphasized that the land claimed as customary land by the people of Kampung Negara Aji Tua, Negara Aji Baru and Bumi Aji is legally under the control of PT BSA’s HGU and has permanent legal force. The document in question is in the form of an HGU certificate issued by the local National Land Agency (BPN), until the court decision ruled in favor of PT BSA in the land dispute. “Based on official documents owned by the government, the land is an HGU of PT Bumi Sentosa Abadi. Its legality has been strengthened by an inkrahct court decision, so that legally ownership and control are valid,” he said, Wednesday (17/12/2025). Helfi said, this provision is in line with Government Regulation (PP) Number 26 of 2001 concerning HGU, Building Use Rights (HGB), and Land Use Rights, which states that HGU is given by the state to legal entities to cultivate land for a certain period of time and have legal certainty during the validity period. Helfi explained that the police together with the regional government have not remained silent in dealing with the agrarian conflict which has been going on for years. According to him, various resolution efforts have been facilitated through dialogue and mediation involving the community, local government and the company. One of the efforts made is to encourage PT BSA to facilitate 20 percent plasma plantations for the surrounding community, as a form of empowerment and socio-economic solution. Furthermore, the scheme, said Helfi, refers to Minister of Agriculture Regulation (Permentan) Number 18 of 2021 concerning facilitating the development of gardens in surrounding communities, which requires companies to facilitate the construction of plasma plantations of at least 20 percent of the total area of plantation business permits. “We, together with the regional government, have invited all parties to sit down together. The company has also been asked to facilitate a 20 percent plasma plantation in accordance with the provisions. However, as it progresses, some residents reject the scheme and want full control over the land,” explained the Regional Police Chief. According to Helfi, this difference in views is why the conflict has not found a common ground and has been prolonged between the parties involved, which continues to this day. The police emphasize a neutral attitude. In handling this problem, Helfi emphasized that the police are neutral and do not take sides with any particular party. All steps taken are based on applicable laws and regulations and legal decisions. “We do not take sides. The police only carry out their duties to maintain security and public order, and ensure that all parties obey the law,” he stressed. Apart from that, he also added, the police at the Central Lampung Police level to the Lampung Regional Police also respect the aspirations of the community, but still have to stay within the framework of the law. “We continue to urge the public to comply with applicable legal norms,” he added. Prioritize preventive and persuasive steps. Helfi further emphasized that the handling of agrarian conflicts in Anak Tuha has always prioritized preventive and persuasive approaches. Police officers, he said, are trying to prevent collisions and actions that could harm all parties. However, the Regional Police Chief reminded that if persuasive efforts are not heeded and have the potential to cause security disturbances or violations of the law, then law enforcement action can still be taken. “We are prioritizing persuasive and preventive steps. But if the situation is not conducive and the law is not obeyed, of course there are law enforcement steps that can be taken,” he stressed. Therefore, Helfi again appealed to the community still occupying the PT BSA HGU land to be cooperative and restrained, in order to maintain the security and order situation in the area. “We hope that the community can work together, maintain conduciveness, and follow the ongoing process,” stressed the two-star police general.
