In the spring, Ikea has several times confronted Biltema with what they mean are two cases of copyright infringement, writes Dagens Juridik.

This applies to two goods that, according to Ikea, are among their most well -known and esteemed: watering can IKEA PS 2002 and the pallet careful.

Claims four million

Ikea’s global franchisor Inter Ikea Systems suits Biltema for both copyright infringement and unfair marketing.

They claim a total of SEK 4 million.

IKEA requires Biltema to be prohibited from manufacturing, stocked, offering and selling the water jugs and pallets that are considered to infringe on Ikea’s copyright – with a penalty of SEK 1 million for both goods.

Ikea also wants Biltema to be forced to destroy the copies that are in their ownership and reimburse Ikea for costs up to SEK 155,000 linked to costs for disseminating information about the judgment in the media.

In addition, a ban on marketing of the products is requested, with a fine of SEK 1 million.

IKEA: Occasionless contact

Ikea states that the two companies have repeatedly been in contact with the goods in the spring, but that this contact was unsuccessful.

According to Ikea, Biltema must have indicated that they should stop selling the products, but the sale has continued.

The car theme has not made a response to the court yet.

Inter IKEA Systems writes to Expressen that they take “the protection of IKEA product design very seriously”, but that they do not want to comment further on the case, because they do not want to influence the legal process.

The Express has applied for Biltema.
