Targeted by administrative and criminal investigations for moral harassment at work, after the complaint of a colleague, the director of the departmental services of National Education (DSDEN) in the Territoire de Belfort saw her contract not renewed on November 1, AFP learned on Friday, confirming information from Ici Belfort Montbéliard. The criminal investigation was opened following a complaint filed in May by an employee of the accused manager, Montbéliard prosecutor Paul-Edouard Lallois told AFP. Mr. Lallois was seized of this file after a decision of expatriation taken by the Court of Appeal of Besançon on May 21. This follows a complaint initially filed with the Belfort public prosecutor’s office in May by an employee of the DSDEN of the Territoire de Belfort, category A executive of the civil service, stationed in academic management in the department, said the prosecutor. There “nature of the facts denounced” in this written complaint, “supported by numerous supporting documents”led the magistrate to open an investigation by the head of “moral harassment in the workplace”. “To date, only one complaint has been filed”he clarified.
At the same time, an administrative investigation was opened by the Ministry of National Education, entrusted to the General Inspectorate of Education, Sport and Research (IGESR), according to the prosecutor. “The documents and conclusions of this administrative investigation were communicated to me and we are proceeding with their use within the framework of the criminal investigation”. This administrative investigation is broader and numerous testimonies have been collected in this context.
Questioned by AFP, the FSU union, whose elected officials provide the secretariat of the F3SCT bodies responsible for issues of health, safety and working conditions, indicated that it had received “a certain number of alerts, in the months following” the person in question took office in Belfort, four years ago. “We took these alerts into account, we reported them”like all those who “appear to carry psychosocial risks”explained Benoît Guyon, union representative. The non-renewal of the DSDEN contract on November 1, he observed, can be seen as one of the “effects” of the administrative investigation, the conclusions of which were not transmitted to the union. Asked by AFP, the rectorate did not respond immediately. According to Ici Belfort-Montbéliard, the person concerned was called to new functions in the Paris region.
