Decoding the Digital Dotted Line: What You Need to Know About Online Service Contracts
In an increasingly digital world, understanding the terms and conditions of online service subscriptions is more critical than ever. This article delves into the specifics of a distance agreement for purchasing content services online, using the example of SIA “Kurzemes Vards” (KV), a Latvian media company, to illustrate key aspects of such contracts.
The Agreement: Parties and Scope
The agreement,as defined,is a legally binding contract between KV and the buyer for the purchase of content services via the liepajnieki.lv or Kurzemes-vards.lv websites. By completing a purchase, the buyer signifies their acceptance of the agreement’s terms, which they are encouraged to save for future reference. This agreement applies to both individual consumers and businesses.
Defining the Service: What Are You Buying?
The agreement covers several distinct content services offered by KV. These include:
- Liepaja Plus: Exclusive digital content, including articles and photos marked wiht the “Plus” designation.
- Kurzemes Vards Electronic Subscription: A digital replica of the printed newspaper, “Kurzemes Vārds,” along with access to previous electronic editions.
- Kurzemes Vārds Printed Newspaper: Physical delivery of the regional newspaper within Liepaja and Grobiņa by AC Kurzemes Vārds SIA, or elsewhere in Latvia via VAS “Latvijas pasts.”
Pricing and Terms: Understanding the Costs
Subscription prices are fixed for the duration of the purchased term. KV reserves the right to modify prices, but must provide at least 30 days’ notice before any changes take effect. Critically, price adjustments only apply to new subscription periods, not those already paid for. All listed prices include applicable taxes, such as VAT, in compliance with Latvian regulations.
Examples of subscription options and their prices include:
- Liepaja Plus (24-hour access): EUR 0.99
- Liepaja Plus (4-week access): EUR 1.99

Purchasing and Payment: How to Subscribe
Service subscriptions can only be purchased after registering or logging in on the website. Buyers must select a payment method and acknowledge that the subscription is a paid service, confirming they have read and understood the agreement. Payments are typically processed via billing card or SMS, frequently enough set up as recurring payments that automatically renew every four weeks (for digital subscriptions) or monthly (for the print newspaper). These automatic renewals continue until the buyer actively cancels the subscription through their registered profile on the site.
Delivery of the Printed Newspaper: Timing matters
The start date for printed newspaper delivery depends on the time of payment:
- Payments made before 2 PM on a business day: Subscription starts the next business day (if delivered by AC Kurzeme name) or after two business days (if delivered by Latvijas Pasts).
- Payments made after 2 PM on a business day: Subscription starts the following business day (if delivered by AC kurzeme name) or after three business days (if delivered by Latvijas pasts).
The Right of Refusal: A Key Exception
Due to the nature of digital content delivery, the standard 14-day right of refusal does not apply to the Liepaja Plus and Kurzemes Vards Electronic Subscriptions. As these services provide immediate access to digital content upon subscription, the buyer waives their right to withdraw from the agreement once the service has been initiated. This is in accordance with Latvian Cabinet of Ministers Regulation No. 255, “Regulations on the Rules of Distance Agreement.”
The Buyer agrees that the service is initiated with the use of the service, thus the buyer refuses to refuse 14 days’ refusal and the repayment of the amount paid on the basis of the Cabinet of Ministers on 20.05.2014. Regulation No.255 “Regulations on the Rules of Distance Agreement”.
Liability, Confidentiality, and Copyright: Protecting Rights and Facts

Both parties agree to maintain confidentiality regarding non-public information shared during the contract period. KV grants the buyer a general license to use the service, but strictly prohibits unauthorized copying, reproduction,or distribution of digital content. KV asserts that it has secured the necessary rights and permissions for all digital content provided through its platforms.
Data Processing: How Your Information is used
Both KV and the buyer act as data controllers, processing personal data for purposes such as contract fulfillment, billing, dialogue, and business analysis. KV commits to protecting personal data and complying with data protection regulations. Buyers have the right to access, correct, or delete their personal data, and to withdraw consent for data processing. These data protection obligations remain in effect even after the termination of the contract.
