This is about the situation from 2019 and the recording showing the mayor of Gdańsk shopping at Biedronka. What caught attention was the fact that Dulkiewicz bought, among others, strong alcohol. She was accompanied by bodyguards while shopping. The video was first published by local journalist Maciej Naskręt. The mayor of Gdańsk brought a lawsuit against him, but the prosecutor’s office discontinued the case in 2020, and the court upheld the discontinuation. How did the recording end up in the journalist’s hands? “Dziennik Bałtycki” described that a security guard was supposed to have made them available to one of his employees.
The PO politician demanded an apology and a payment of PLN 50,000 from Biedronka and the security company. PLN for the Burego Misia Community Foundation. In addition, she demanded PLN 10,000. PLN for herself and one of her colleagues who appeared in the film. The verdict in the case was handed down on Friday, November 28.
Dulkiewicz versus Biedronka and the security company. The verdict has been passed
The District Court in Gdańsk dismissed the lawsuit against the owner of Biedronka. – The court found that the defendant Jeronimo Martins Polska SA is not responsible for the actions of its employee. She only used the knowledge about the mayor’s visit to the Biedronka store and his acquaintance with the security employee. She acted as a private person, outside the scope of her official duties, so her employer was not responsible for her actions – said the spokesman for criminal cases of the District Court in Gdańsk, Judge Mariusz Kaźmierczak.
However, the court found the security company guilty, whose employee copied the recording and passed it on to another person. According to the judgment, the company was obliged to apologize to Dulkiewicz and her colleague. The apology is to be published on one of the front pages of the daily newspapers “Gazeta Wyborcza” and “Rzeczpospolita”. The security agency must also pay PLN 10,000. PLN 10,000 for the Burego Misia Community Foundation and PLN 5,000 each for Dulkiewicz and her collaborator.
The judgment in this case is not final, which means it can be appealed. The person concerned did not appear in court on Friday.
