Dublin Man Given Suspended Sentence for Possessing Child Abuse Material

In a recent case at the Dublin Circuit Criminal Court, Nikita Dvoynin, a 24-year-old man from Clonee, Dublin 15, has received a suspended sentence for possessing over 1,800 images of child abuse material. The Discovery and Investigation

Dvoynin’s involvement came to light after an exchange of child-explicit material was noted on the Discord app, an instant messaging platform. Detective Garda Brendan Cafferkey traced the exchange to Dvoynin’s address and obtained a warrant to search his home.

Upon entering Dvoynin’s residence, law enforcement found several digital devices, which were later analyzed. Dvoynin voluntarily admitted to the officers that the devices would contain “child pornography.” Among the devices was a computer built by Dvoynin himself.

The Extent of the Offense

The digital devices yielded a total of 1,838 images, with 1,141 classified as highly explicit and involving the abuse of children as young as two years old. These images were stored in a secured folder on Dvoynin’s mobile phone.

The Legal Proceedings

Dvoynin pleaded guilty to the possession of child pornography on 9 April 2021. During the trial, the prosecution outlined how the exchange was initially noted on Discord. Detective Garda Cafferkey confirmed that subsequent analysis of Dvoynin’s devices yielded a staggering amount of child abuse material.

John Berry, SC defending Dvoynin, presented a report from a neuropsychologist who concluded that Dvoynin has issues with social interaction and non-verbal communication. The report indicated that Dvoynin could develop intense interests in specific topics and maintain numerous online relationships, often struggling to distinguish between these online interactions and real-life relationships.

Court’s Considerations and Sentence

Berry highlighted several mitigating factors, including Dvoynin’s immediate cooperation with the police, his young age at the time of the offense (19 years old), and his expressed remorse. He also emphasized his client’s insistence that he would not engage with a child in real life.

The judge imposed a two-year sentence, which was suspended in full on strict conditions. These conditions include mandatory engagement with the Probation Service for 12 months.
