Even though he was aware of being HIV positive forced a 37-year-old woman of Polish nationality, a friend of his wife, to undergo repeated sexual acts without protection, accepting the risk of causing her death by hiv as then happened on November 3, 2017. The Prosecutor’s Office Napoli (IV section, deputy prosecutor Raffaello Falcone, deputy prosecutor Valentina Maisto) asked for a 24-year prison sentence for the alleged culprit, a man of around 65 years of age, at the end of the prosecutor’s indictment in room 115 of the new courthouse in Naples where, before the Court of Assizes, a trial is being held in which, among other things, the crime of voluntary homicide is being contested.
The accused is also charged with the crime of causing very serious injuries for having had unprotected sexual intercourse with his wife without the woman being previously informed of the fact that he was HIV positive, causing an illness for which he is currently being treated.
The story in the classroom
The videos of the victim, shown during the hearing and the statements made by the plaintiff’s lawyer who recalled that the 37-year-old had arrived in Italy at just twenty years old were touching.with a suitcase full of dreams» and then meet the one who would become «his tormentor and his murderer».
According to what emerged, the woman was raped (and then apparently also blackmailed) at least ten times in the early 2000s (between 2001 and 2003), a period in which she lived at the defendant’s house as a friend of his wife, also of Polish nationality.
In one of the videos shown during the indictment, the victim, in a hospital bed, visibly debilitated by AIDS, remembers the violence suffered in Ischia: «I remember the first time, he punched me and raped me. It happened about ten times. Then he threatened to kill me if I spoke and I remained silent.” The defendant’s lawyer asked for acquittal on both counts. The possible reply from the prosecutor and the sentence are expected on March 25th.
