California is again the focus of the discussions about regulating artificial intelligence (AI). A new law, which was introduced by the ambitious Democrat Scott Wiener, calls for AI companies to disclose their security protocols and to certify their compliance. This measure could not only influence the Californian technology industry, but also serve as a model for national standards.

Governor Gavin Newsom, who may be preparing for a presidential candidacy in 2028, is faced with a difficult decision. On the one hand, he has to take into account the concerns of voters about the risks of AI, on the other hand, such a law could put a strain on relationships with the financially strong tech companies. Last year, Newsom had rejected a similar law on the grounds that it could endanger California’s innovative strength.

The current law is a weakened version of the original proposal and is based on a report that Newsom commissioned according to its veto. It requires large AI companies to disclose basic information about their security tests, while smaller companies with less than $ 500 million annual sales have to submit more detailed reports. So far, these changes have largely averted the loud opposition of the industry, which was observed last year.

The support of companies such as Anthropic and the constructive debate with Openai show that the industry is ready to deal with legislation. Nevertheless, the Californian Chamber of Commerce remains skeptical and has expressed concerns that the law is too focused on large developers and ignores other potentially risky models. Newsom’s decision could not only affect the future of AI regulation in California, but also at the national level.
