Biden Surpasses Trump’s Judicial Appointments: Legacy of Diversity on the Federal Bench

President Biden is on track to achieve a significant milestone, confirming his 235th judicial appointment by the end of the week. This accomplishment surpasses the 234 confirmed judges appointed by former President Trump, highlighting the Democrats’ focused effort to reshape the federal judiciary.

Diversity Takes Center Stage

A key feature of Biden’s judicial appointments is the emphasis placed on diversity. Nearly two-thirds of his appointees are women, while a majority are people of color. This conscious effort to broaden the demographic representation on the bench represents a significant shift from previous administrations. Notably, Biden’s appointments include Ketanji Brown Jackson, the first African-American woman to serve on the Supreme Court, further cementing this legacy.

Senator Dick Durbin, Democratic chairman of the Senate Judiciary Committee, emphasizes the positive impact of this diversity, stating, "Prior to our effort, the number of women on the federal bench was really diminished. It was overwhelmingly white males. We consciously moved forward to bring more women to the bench, and believe me, we had a great talent pool to work with. So I think it’ll enhance the image of the court and its work product to bring these new judges on."

Expanding Judicial Expertise

Beyond demographics, Biden’s nominees bring a wider range of professional backgrounds to the bench. More than 45 appointees come from public defender backgrounds, and over two dozen served as civil rights lawyers, enriching the judiciary with diverse legal perspectives.

“For our federal judiciary to actually deliver equal justice for all, it really has to be for all, and that is one reason why we certainly applaud this administration for prioritizing both professional but also demographic diversity,” said Lena Zwarensteyn, senior director of the fair courts program at The Leadership Conference on Civil and Human Rights.

Despite the accomplishments, Biden’s judicial appointments were challenging, with a closely divided Senate adding complexity to confirmations. The urgency of securing judges grew as Republicans consolidated their power on the Supreme Court, reversing established precedents on abortion, affirmative action, and environmental regulations.
