Ayuso’s Boyfriend: Magistrate & Attorney General Conflict

The judge of the Supreme Court, Antonio del Moral, who was one of the five members of the court who admitted the reasoned statement to be processed to investigate Álvaro García Ortiz and who has been one of those who signed his sentence, directed the thesis of the lawyer of Ayuso’s boyfriend, a private accusation in this case. As reported by eldiario.es and confirmed by Cadena SER, Gabriel Rodríguez Ramos defended his work at the Complutense University on October 15, 2024, the same day that the high court opened the criminal process against the former attorney general.

In the acknowledgments chapter of his doctoral thesis entitled “Fundamental identity of punishable business action”, Rodríguez Ramos has words of gratitude for his two directors and writes “to my directors for their effort, their patience and for the wise guidance they have given me throughout this time to get me here.” Together with Del Moral, Alfredo Liñán directs the thesis.

The organic law of the Judiciary establishes “manifest friendship” as a cause for abstention in judicial processes. Professors consulted by Cadena SER maintain that the aspiring doctor and his thesis director establish a “qualified relationship of trust” and a “deep personal and professional bond because your professional career depends on the director and his prestige is linked to the result of the doctoral thesis.” The thesis director reviews the work, each text, and until it is ready he does not allow you to defend it. In this sense, they emphasize that in the university world a thesis director does not participate in the future selection processes to which his pupil aspires nor does he form a tribunal to evaluate any of his subsequent works.
