Last week Apple reactivated the blood oxygen measurement to US Apple Watches via software update. The feature was not usable for one year and a half due to patent disputes. Masimo, the opponent in the said procedure, now wants to proceed again against the judicially stained solution.
By detour via the iPhone, Apple was able to bypass the component under the patent law in the Apple Watch last week. Around 2023/2024, a patent dispute between Apple and Masimo caused a short -term sales stop of the Apple Watch in the USA. Since then, the blood oxygen measurement in the USA has been deactivated on the software side.
Masimo is suing the US customs authority
According to its own statements, Apple voted the reactivation at the beginning of August with authorities. Masimo is now complaining to the permission granted, the company sees the competencies of the supposedly responsible authority exceeded. The CBP (US Customs and Border Protection) responsible for customs and border protection had withdrawn an earlier blockade of a software solution on August 1st and allowed Apple to restore it via software update. Masimo found out about Apple’s public announcement, reports Bloomberg Law.
According to this, Masimo is now calling for an injunction, the decision of the CBP is to be blocked and the blood oxygen measurement will be again deactivated. We keep you up to date with the developments.
