We feel, we see urine and excrement everywhere in our building, even at the entrance. There was blood, vomit, we feel everything. It is not sure for us, we are afraid of microbes, we are afraid to get sick.

These concerns extend to the handling of deceased animals,with residents expressing unease about the storage of carcasses awaiting collection. Furthermore, some residents report developing allergies, which they attribute to the presence of animals in the building.According to the Asthma and Allergy Foundation of America, approximately 3 in 10 adults in the US have allergies. The presence of animals in a shared living space can exacerbate these conditions.

Safety is another major point of contention. One resident, a mother of a young child, voiced concerns about the presence of large dogs in the building’s confined spaces.

Large dogs enter the building and the spaces are restricted. We cannot maintain a safety distance and we cannot predict the reaction of animals to our children.

Escalating Tensions and Allegations

The situation has become increasingly fraught, with reports of heated exchanges and even physical altercations. An employee of the veterinary clinic was reportedly injured in an incident, highlighting the intensity of the conflict. Both sides accuse each other of defamation and property damage, further fueling the animosity.

Property Values at Risk?

The dispute has also raised concerns about the potential impact on property values. One resident expressed fears that their property, particularly those on the ground floor, has become unsellable due to the presence of the clinic. The resident stated that the property is valued at 1 million euros, and with registration fees, it would cost 1.2 million euros to resell. They believe that no one would be willing to pay that much with a clinic next door.

Questions of Due Process and Transparency

Residents have also criticized the municipality of Hesperange and the building’s co-ownership trustee. They allege that they were not adequately informed about the plans for the veterinary clinic before its approval. According to the residents, the municipality issued a non-objection document under the condition that third-party rights were respected and that all residents were informed. Though, they claim that they were not informed in time to react effectively.

The role of the trustee has come under scrutiny,with both residents and the veterinarian questioning whether the trustee adequately represented their interests. The veterinarian reportedly claims they were not informed that the other residents opposed the opening of the clinic.

Seeking Resolution: Legal Action and Relocation

In response to the growing discontent, the municipality has referred the matter to the health inspection authorities. While an initial inspection reportedly found no major issues, residents argue that the inspection was too narrowly focused. The residents are now exploring legal action against the trustee and the owner of the apartment leased to the veterinarian. Mayor Marc Lies has acknowledged the possibility of legal action. The veterinarian is reportedly seeking alternative premises, suggesting a potential resolution to the conflict.
