A woman in her 30s was sentenced to prison for falsely filing a false complaint while working at a company with a romantic partner, saying, “If you don’t give me unemployment benefits, I will report you for rape.”
She committed this crime after having an affair with a married man for several years and becoming pregnant with another man’s child.
According to the legal community on the 31st, the Western Branch of the Busan District Court (Chief Judge Baek Gwang-gyun) sentenced Mr. A, who was indicted on charges of false accusation and attempted coercion, to 1 year and 6 months in prison on the 1st.
Mr. A has been in an affair with Mr. B, a married man in his 40s, for several years.
Mr. A has been listed as an employee of Mr. B’s company and has also received financial support in the form of salary.
Meanwhile, around July 2023, Ms. A became pregnant with another man’s child.
He broke up with B because she was pregnant with another man’s child. A few days later, he contacted B, saying, “The child in your stomach is your child.”
At the same time, he demanded that his resignation be recommended so that he could receive unemployment benefits, and threatened that if he did not comply, he would “report it as rape.”
When the company did not meet his demands, Mr. A filed a complaint against Mr. B for rape at the Busan Gangseo Police Station on November 13 of the same year.
Person A claimed to the police, “I was raped twice by the victim on June 7th and 28th at a hotel and rooms C and D in Gangseo-gu, Busan.”
However, as a result of the police investigation, the complaint was found to be false, and Mr. A was eventually handed over to trial on charges of false accusation.
Regarding this case, the court strongly criticized Mr. A, saying, “Mr. A used the pregnancy as an excuse to request a false recommendation to resign from the victim in order to receive unemployment benefits, and when she was refused, he was extremely ungrateful and falsely accused the victim of rape.”
He then pointed out, “During the trial, Mr. A showed wrong behavior by contacting and pressuring the victim under the pretense that his mother was a reporter,” and “It was also revealed that he recklessly sued the victim and made her suffer through the investigation and trial procedures.”
At the same time, he explained the reason for sentencing, saying, “Due to the nature of rape cases, the victim’s statement is often the only evidence, so the damage to trust in the judiciary due to false accusation is serious. Making an innocent person a rape suspect causes pain that is difficult to recover from. Mr. A maintained that it was a legitimate complaint despite clear evidence, and there was no apology or compensation while ignoring the victim’s pain.”
