Council to Deliberate on AMV Reception Scenarios
the Achtkarspelen city council is set to convene on May 22nd in Buitenpost to discuss and decide on the municipality’s approach to receiving unaccompanied minor asylum seekers (AMVs). The Municipal Executive has outlined four potential scenarios, each presenting distinct advantages and challenges, requiring the council to determine its preferred course of action.
Four Potential Pathways Forward
The council faces a critical decision, with the following options on the table:
- Abstain from establishing AMV care facilities and await further developments concerning the Spreading Act.
- Implement reception services for 14 AMVs, adhering to the Minister’s distribution directive.
- Establish childcare provisions for 50 amvs, a number deemed potentially feasible for the central Agency for the Reception of Asylum Seekers (COA).
- Integrate the reception of 14 AMVs into a larger asylum seekers’ center (AZC) accommodating 150 individuals.
The Shadow of the Spreading Act
This debate unfolds against the backdrop of the Spreading Act, enacted on February 1, 2024. This legislation mandates municipalities to accommodate asylum seekers. Minister Faber van Asiel & Migration previously designated Achtkarspelen to receive 14 AMVs before July 1, 2025, as part of the Fryslân distribution plan.
While the current minister has expressed intentions to repeal the Spreading Act, it remains legally binding. Consequently, Achtkarspelen is still obligated to comply with its provisions until any official revocation occurs.This legal uncertainty adds complexity to the council’s decision-making process.
Conflicting Interpretations of “Small-Scale” Reception
In January 2024, the council passed a motion advocating for small-scale reception centers. The motion emphasized that small-scale daycare is better for the asylum seekers and also more appropriate to the size of our villages.
However, the Commission highlights the divergent interpretations of “small-scale.” The COA considers facilities housing around 150 individuals as small-scale, while many residents envision a considerably smaller setting, perhaps accommodating only ten to twenty people.This discrepancy in understanding poses a challenge in aligning reception plans with community expectations.
Weighing the Pros and Cons of Each Scenario
The Municipal Executive has carefully assessed the arguments and potential risks associated with each scenario. Opting for scenario 1 (no reception) carries the risk of potential inter-administrative supervision, potentially leading to the central government assuming control of municipal responsibilities.
Scenario 2 (14 AMVs) raises concerns about potentially high costs and placing a disproportionate burden on the COA. Scenario 3 (50 AMVs) aligns more effectively with the COA’s operational capacity but may encounter greater public resistance. Scenario 4 (AZC of 150 people) is hampered by the current lack of a suitable location within the municipality.
Next Steps: Towards a Principle Decision
Following the council debate on May 22nd and the selection of a preferred scenario, the Municipal Executive will formulate a principle decision in the autumn of 2025.This decision will pave the way for the implementation of the chosen approach to AMV reception in Achtkarspelen.
