Suspension from the public office of justice of the peace and disqualification from practicing the legal profession for 12 months.
There are 8 personal precautionary measures ordered, at the request of the Public Prosecutor’s Office, by the Judge for Preliminary Investigations at the Court of Rome, carried out by the provincial command of the Guardia di Finanza of Caserta and by the Caserta police headquarters against 8 suspects, all justices of the peace and lawyers, accused of corruption in the context of the phenomenon of insurance scams linked to fictitious road accidents.
They are the justices of the peace Maria Gaetana Fulgeri, Rodosindo Martone, Bruno Dursio and the civil lawyers Giuseppe Luongo (already placed under house arrest, believed to be the head of the association), Giuseppe Michele D’Amico, Michele Zagaria, Vincenzo Castaldo, Michele Chirico.
The investigation
The activity, coordinated by the Capitoline court, made it possible to reconstruct the role of the professionals of the court who had the task of taking care of the entire process relating to false road accidents in order to pilot the outcomes to their advantage.
In particular, the lawyers maintained relationships both with technical consultants appointed by the Judges in order to obtain favorable assessments and with the doctors and lawyers designated by the insurance companies.
The investigations, conducted by the State Police of Caserta – Flying Squad and by the Guardia di Finanza – Economic-Financial Police Unit of Caserta, revealed how the accidents, although distinct from each other in terms of times, places and subjects involved, presented completely overlapping anomalies and dynamics; among the most recurrent were the collision of pedestrians on pedestrian crossings or people on bicycles (even two-seater “tandem”), or the failure of police operators to arrive on site.
The ‘victims’ of the false claims, mostly gathered in the outskirts of Casal di Principe, were paid 150 euros at the time of the fake report up to 500 euros for the final outcome of the case.
Piloted sentences
The investigative activities also made it possible to ascertain the involvement of the three Justices of the Peace of the Court of Santa Maria Capua Vetere who, in exchange for the payment of sums of money, would have issued compliant sentences in favor of the lawyers, by accepting requests for compensation for damages resulting from physical and moral injuries suffered by various subjects following false claims reported. In exchange they obtained luxury goods for ‘friends’, favors to place family or friends in competitions.
The investigators also executed a preventive seizure decree for a value of over 300,000 euros against the suspects.
