Kilmar Abrego Garcia Seeks Sanctions Against Trump administration for stonewalling Inquiry

Kilmar Abrego Garcia, who was wrongly deported to El Salvador from Maryland and then faced migrant smuggling charges upon his return, is now seeking sanctions against teh Trump administration. He alleges they obstructed an inquiry into the efforts to bring him back to the U.S.


the case has ignited debate over President Donald Trump’s strict immigration policies, with critics citing it as an example of the administration’s alleged disregard for due process and court orders in its deportation efforts.

In a recent court filing, abrego Garcia’s legal team requested that a judge penalize the federal government for not providing sufficient details regarding the actions taken by U.S.agencies to comply with court orders related to his return.

“The Government’s defiance has not been subtle. It has been vocal and sustained and flagrant,” Abrego Garcia’s lawyers wrote in the filing.

The filing urges U.S. District Judge Paula Xinis to conclude that the trump administration failed to take all possible steps to facilitate his return. It also seeks unspecified fines and demands that U.S. officials release previously withheld documents, citing legal privileges.

Neither the U.S. Justice Department nor the Department of Homeland security have responded to requests for comment on the filing.

The Trump administration maintains that it complied with court orders by bringing Abrego Garcia to Tennessee to face a federal criminal indictment for allegedly transporting migrants living in the U.S. illegally.

Abrego Garcia’s lawyers have dismissed the charges as “fantastical” and insist that the indictment should not halt the separate lawsuit concerning his wrongful deportation in March. Abrego Garcia is scheduled for a detention hearing in the criminal case on Friday.

The Trump administration has accused Abrego Garcia of being a member of the MS-13 street gang, an allegation his lawyers deny.

The U.S. Supreme Court mandated that the Trump administration facilitate Abrego Garcia’s return after U.S. officials admitted he was mistakenly deported to El Salvador, despite a prior court order preventing his deportation there.

Administration officials initially claimed they could not compel El Salvador to return Abrego Garcia from Salvadorian prison to U.S. custody.

Judge Xinis, who is overseeing the lawsuit, dismissed these arguments and, in April, allowed Abrego Garcia’s lawyers to question U.S. officials and seek documents regarding the steps taken by the Trump administration to secure his return.

The Trump administration has cited legal privileges, arguing that it does not have to disclose information that could impact U.S. national security or complicate diplomatic negotiations.
