Final Verdict: 23 Years for Misano murder
The highest court in Italy,the Court of Cassation,has upheld the 23-year prison sentence for Edi Zegarac,a 54-year-old man convicted of the brutal murder of Nicola Donadio,age 50. The crime occurred on January 12,2022,in Misano Adriatico,a coastal town in the Emilia-Romagna region. This decision marks the end of a lengthy legal battle, bringing a measure of closure to the victim’s family.
From Minor Sentence to Major Conviction: A Legal Overview
Initially,zegarac received a sentence of 15 years and 4 months. The court at the time did not recognize the aggravating circumstance of “futile reasons.” However, the prosecution, led by public prosecutor Davide Ercolani, and the civil parties – Donadio’s four daughters and wife, represented by lawyer Massimo Melillo – appealed the decision. They argued for a harsher penalty, emphasizing the seemingly senseless nature of the crime and the victim’s limited ability to defend himself.
The Bologna Court of Appeal reconsidered the case, focusing on these critical aspects. Ultimately, they sided with the prosecution, increasing Zegarac’s sentence to 23 years. Massimiliano Orrù, Zegarac’s lawyer, mounted a defense, but the appellate court remained unconvinced.
The Crime: A dispute Escalated to Tragedy
The tragic event stemmed from a dispute between Zegarac and Donadio, who were neighbors residing in temporary housing provided by the Municipality of Misano. These modules were intended to assist individuals facing housing emergencies. The location was near a purifier along the Via Nazionale Adriatica Internal Adriatic.
Zegarac confessed to the crime shortly after his arrest, reiterating his version of events to the investigating judge. He admitted to waiting for Donadio to return home from work in the early hours of January 12th. His stated intention was to persuade Donadio to withdraw a previous complaint filed against him regarding neighborhood disputes. However, Zegarac claimed to have experienced a “mental blackout” upon encountering Donadio, after which he had no clear recollection of the events that followed.
According to the carabinieri’s investigation, Zegarac attacked donadio with an iron handlebar from a gym, inflicting multiple blows to the head. He then left Donadio’s lifeless body on the ground. Neighbors, residing in caravans and prefabricated structures within the municipal field, heard Donadio’s screams and alerted the authorities.
Desperate Attempts and a Haunting Confession
Upon arrival, law enforcement officers found Donadio still alive, though barely. With his last breaths, he identified zegarac as his attacker. Zegarac, who had retreated to Donadio’s shack, was apprehended shortly thereafter. despite the immediate efforts of the carabinieri and the 118 emergency medical team, Donadio succumbed to his injuries at the scene.
Zegarac maintained that he had no memory of the attack itself, claiming to have “awakened” in the bathroom of Donadio’s residence. Described by some as a mild-mannered and cultured individual, Zegarac expressed bewilderment at his own actions, stating that he could not explain how he found the strength and courage to commit such a heinous act.
