According to RCI’s executive director, Dr. Clíona Saidléar, the limitations of the register and the lack of proper regulation allow convicted sex offenders, particularly those working with adults, to evade professional sanctions.

Flynn’s occupation as a personal trainer did not necessitate registration with any professional body. Consequently, there was no mechanism to strike him off the profession. Without children involved, no additional vetting procedures were applied, thereby leaving a gap in the preventive measures designed to safeguard the public.

Flynn, 35, was sentenced to two years and four months in prison for sexually assaulting a woman who sought treatment for chronic back problems in 2001. The court also found him guilty of secretly filming 35 women without their consent during massage sessions. Though none of the recordings involved non-consensual acts, the secret filming itself was illegal.

Flynn’s crime involved 18 hours of video footage, showcasing the extent to which he abused his position of trust. The brazen nature of these incidents highlights the need for stricter oversight in personal care professions.

Dr. Saidléar expressed deep concern over the potential risks posed by Flynn’s impending release. While Coru, Ireland’s health and social care professional regulator, has promised reform for decades, tangible progress remains elusive. However, these advancements must be coupled with a sense of urgency to protect the public, as highlighted by cases like that of Shane Flynn.

Upon his release, Flynn must complete a sexual offending treatment program and undergo probation supervision for one year. Despite his status as a registered sex offender, there are no barriers preventing him from re-establishing his personal training business.
