Indonesian Nationals Facing Death Penalty Abroad: Government Takes Action

Jakarta – A concerning development in the international criminal justice arena has come to light, with 157 Indonesian citizens currently facing the death penalty in foreign countries. According to the latest figures as of January 2025, this issue has gained significant attention from the Ministry of Foreign Affairs.

Majority in Malaysia for Drug Trafficking Cases

The ministry’s director of citizen protection, Judha Nugraha, provided an update on Tuesday, January 28, 2025. He stated that the majority of these individuals are incarcerated in Malaysia, where they have been convicted of drug trafficking. This represents a significant challenge for Indonesian authorities to navigate the complexities of international legal systems.

Government’s Legal and Diplomatic Efforts

In response to this crisis, the Ministry of Foreign Affairs has launched a multifaceted approach to safeguard the citizens’ rights. Legal assistance is being provided to all prisoners, ensuring that no Indonesian national faces sentencing or execution without proper representation. Additionally, diplomatic protection is extended to those whose cases have been finalized.

Negotiations for Repatriation

Coordinating Minister for Law, Human Rights, Immigration, and Corrections, Yusril Ihza Mahendra, elaborated on the next steps the government plans to take. He highlighted that repatriation of Indonesian death row prisoners from Malaysia and Saudi Arabia would be negotiated after the completion of the process of transferring them to their home countries.

Regulation and Policy Development

Mahendra emphasized the need to finalize the regulation on prisoner transfer and exchange. This process involves not only establishing effective policies but also negotiating with other countries to ensure these transfers are possible. The government is committed to adhering to international standards and maintaining the sovereignty and dignity of its citizens.

Special Focus on Saudi Arabia and Malaysia

The government’s efforts are particularly centered on addressing the cases of prisoners in Saudi Arabia and Malaysia. These countries have some of the harshest penalties for drug offenses. Mahendra noted, “There are a considerable number of Indonesian citizens on death row in these countries but have not yet been executed.”

Engaging with Families

An essential component of the repatriation process is engaging with the families of the inmates. Open communication and consultation are critical to understanding the nuances of each case and ensuring that families are adequately informed and prepared for the potential repatriation.

Commitment to Citizen Protection

Mahendra reiterated the state’s unwavering commitment to protecting its citizens. He stated, “The state is required to protect its citizens regardless of ‘whatever the mistakes may be, or whatever their ideologies are.'” This sentiment underscores the government’s responsibility to uphold the rights and welfare of all its nationals.
