Philippines Takes Firm Stance Against Offshore Gaming Operators

The Philippine government is gearing up to enforce the ban on Philippine offshore gaming operators (POGOs) with a series of stringent actions. The Office of the Solicitor General (OSG) has initiated the proceedings for the seizure of illegally acquired properties and assets owned by POGO operators in the country. Additionally, there are plans to cancel fraudulent birth certificates issued to foreign POGO workers, further solidifying the government’s commitment to eradicating illegal gambling activities.

OSG Launches Seizure Plan

According to Solicitor General Menardo Guevarra, the OSG’s primary mission is to execute the ban on POGOs, declared by President Marcos in July. “The cleanup of POGOs is essential following the President’s directive. The OSG will require the assistance of various government agencies and the support of Congress for the legislative actions necessary to implement this massive cleanup,” he explained in an interview with The STAR.

The solicitor general admitted the scale of the task at hand. “There are countless fraudulent birth certificates issued to foreign POGO workers that need to be invalidated,” Guevarra said. However, precise figures on the total value of assets remain elusive. “This process will depend significantly on legislative action, making it easier to cancel fraudulent birth records and seize civilly forfeited assets,” he added.

Progress is being made on the legislative front, with the House of Representatives approving House Bill 11117—the proposed fraudulent birth certificate cancellation law. This move aims to expedite the cancellation process for fraudulent birth certificates issued to foreign nationals.

Mobilizing Anti-Money Laundering Authorities

Under the Anti-Money Laundering Act of 2001, the government holds the power to seize assets and money linked to illegal activities without the need for a criminal conviction. This authority will be invoked to confiscate assets from POGO operators.

Presidential Anti-Organized Crime Commission Issues Warnings

As enforcement efforts ramp up, the Presidential Anti-Organized Crime Commission (PAOCC) has issued critical warnings to property owners. Executive Director Undersecretary Gilbert Cruz stressed the importance of vigilance when renting properties to foreigners. “They may face legal consequences, including the loss of property, if their rentals are used for illegal activities,” Cruz emphasized in an interview on dzBB.

Persistent Threat and Shifting Tactics

Despite the ban, POGO operators are adopting a more discreet approach. In September, authorities rescued at least 162 foreigners from a POGO hub in Lapu-Lapu City, Cebu. According to Cruz, these operators are now fragmenting their operations, utilizing resorts, condominiums, and other establishments.

Collaboration and Reporting

The PAOCC is augmenting its collaboration with local government units (LGUs) to monitor and prevent illegal activities. Cruz advised the public to report any suspicious activity, such as increased foreign presence, 24-hour operations, and heightened internet usage.

Some telltale signs of small-scale POGO hubs include:

  • The presence of foreigners.
  • 24-hour operations.
  • Increased food deliveries.
  • Enhanced internet connectivity.
  • Regular vehicle movements, especially those carrying computers and other operational equipment.

“If you notice these indicators, it’s important to report them to law enforcement,” Cruz emphasized.
