DETROIT LAKES

— Eduardo Ramos Garcia Jr., 47, of Gaylord, Minnesota, has been charged in Becker County District Court with two counts of felony DWI; felony fleeing a peace officer in a motor vehicle; and gross misdemeanor driving after his license was canceled as inimical to public safety.

According to court records, about 12:20 a.m. on June 10 a state trooper saw him driving erratically on westbound Highway 10 entering Detroit Lakes.

The trooper activated his emergency lights at North Shore Drive. The vehicle did not pull over, so the trooper put his spotlight on the vehicle. The vehicle’s brake lights came on and the vehicle signaled and changed into the right lane, but didn’t pull over.

The trooper then activated his siren near the Sandbar. The vehicle’s brake lights activated but the vehicle continued to weave and travel westbound on Highway 10. The vehicle continued traveling past Summit Avenue, at which time the trooper successfully completed a PIT maneuver to force the vehicle to stop.

The driver, Garcia, wouldn’t get out, and the officer had to reach in and unlock the door to remove him from the vehicle. While doing so, the trooper could smell the strong odor of an alcoholic beverage and saw an open beer can in the center console.

Garcia was taken to jail, where he ultimately declined to submit to DWI testing, saying that he had not been pulled over for a valid reason. He was convicted of felony DWI in 2013 and his license status remains cancelled as inimical to public safety.

His next court appearance is set for July 7.

He was able to get out, and officers were eventually able to get him to the ground. While on the ground, Bialke’s head was near a basketball hoop base, and he then purposefully slammed his head into the basketball hoop base.

Bialke eventually complied with commands and was placed back into the rear seat of the squad car. He then began to slam his head into the partition of the squad car. Bialke eventually stopped and was transported to the Becker County Jail, according to the criminal complaint.
