FedEx Sues Trump Admin Over Customs Tariffs | Trade War Update

The package delivery group FedEx filed a complaint on Monday against the US government, seeking reimbursement for sums unduly collected due to customs duties illegally implemented by Donald Trump.

According to a court document consulted by AFP, FedEx is asking the American Court of International Trade to force the United States to “refund (…) the duties collected from them on all imports” subject to surcharges now canceled by the Supreme Court, “plus the interest provided for by law”.

This is the first complaint of its kind filed by a large American company since Donald Trump suffered a snub over his trade policy.

The United States Supreme Court ruled Friday that the American president had exceeded his powers by imposing customs duties on numerous products without obtaining approval from Congress.

The move paves the way for possible refunds of surcharges already paid by businesses, the amount of which exceeded $130 billion last year, according to analysts.

Questioned on this subject on Friday, the Head of State stressed that this question had “not been addressed” by the Court and estimated that it would occupy the courts for years.

Several companies, such as the supermarket chain Costco and the American subsidiary of the Japanese manufacturer Toyota, had already filed a preventive complaint before the Supreme Court’s verdict.
