Article 115 of the Finance Law for 2018, published in the Official Journal on December 31, 2017, restores the waiting day in the civil service.
This waiting day concerns public employees (civil servants and contractual workers) and stipulates that remuneration is due from 2e day of sick leave.
However, the waiting day does not apply when the agent has not returned to work for more than 48 hours between 2 sick leaves for the same cause (Please note: make sure that your doctor has checked the “Extension” box).
It also does not apply to the following holidays:

  • leave for service accident or work accident and occupational illness,
  • long sick leave,
  • long-term leave,
  • serious illness leave,
  • leave of the injured (for the military).

Please note:

  • Special case of long-term illnesses (ALD): in this case all CMO linked to the same ALD are only subject to one deficiency day in a period of 3 years.
  • A contractual agent on sick leave can be compensated with a waiting period of 3 days if their seniority is less than 4 months of service.
