The certification training on business restructuring according to OHADA legislation takes place in an economic context marked by profound changes, increased competition and a need for companies operating in the OHADA space to adapt their organizational, financial and legal strategies.
Faced with the challenges of performance, governance, financing and regulatory compliance, mastery of the legal mechanisms provided for by OHADA law — in particular the Uniform Act relating to the law of commercial companies and the GIE, as well as the Uniform Act on collective procedures for the clearance of liabilities — becomes essential to ensure the sustainability and competitiveness of companies.
This is an immersive training course of 10 hours of training time spread over 5 weeks at a rate of 2 hours of training time per week.

Training objectives
At the end of this training, participants will be able to:
- Understand the OHADA legal framework applicable to business restructuring, including provisions relating to structural modifications, mergers, divisions, transformations and financial restructuring;
- Identify the signs of fragility of a company and analyze its needs for strategic, operational or legal restructuring;
- Master the collective procedures offered by the Uniform Act, such as the prevention of difficulties, preventive settlement, provisional administration or recovery procedures;
- Develop and implement a restructuring plan that complies with legal requirements and is adapted to performance objectives;
- Ensure the legal certainty of restructuring operations by respecting obligations towards shareholders, creditors, administrations and partners;
- Effectively advise companies in their transformation, financial consolidation or organizational adaptation initiatives.
